A class action settlement agreement and release (“Settlement Agreement”) has been proposed in a class action lawsuit in the U.S. District Court for the Middle District of Pennsylvania against Bath Saver, Inc. and Bath Fitter Manufacturing Inc. (the “Action”).

An individual (the “Plaintiff”) filed a lawsuit against Bath Saver, Inc. and Bath Fitter Manufacturing Inc. (“Defendants”) on behalf of herself and all others similarly situated. The lawsuit alleges that Defendants or their affiliates violated the Telephone Consumer Protection Act, 47 U.S.C. § 227 (the “TCPA”) by placing unsolicited telephone calls (“Calls”) to Plaintiff and the Settlement Class Members.

Defendants deny they did anything wrong and have defended themselves throughout the Action. The Court has not decided who is right. Both sides have agreed to settle the dispute to avoid burdensome and costly litigation. You may be a Class Member in the proposed Settlement and may be entitled to participate in the proposed Settlement.
